Notice: These terms are currently under development and subject to change as we finalise our regulatory and legal structure. They represent our current operating intentions and will be updated as VirtualSilvr establishes its legal entity and jurisdiction.
Please read these Terms of Use carefully before using the VirtualSilvr Markets platform. These terms govern your access to and use of our services.
1. Acceptance of Terms
By accessing or using the VirtualSilvr platform ("Platform"), you agree to be bound by these Terms of Use. If you do not agree to these terms, you may not use the Platform. VirtualSilvr Markets ("VirtualSilvr", "we", "us") reserves the right to modify these terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised terms.
2. Platform Description
VirtualSilvr provides data, intelligence, and analysis relating to AI infrastructure companies, funding events, market signals, and related information ("Content"). The Platform is designed for informational and research purposes only. VirtualSilvr is not a regulated investment adviser, broker-dealer, or financial institution. Nothing on the Platform constitutes investment advice, a recommendation to buy or sell securities, or an offer to enter into any investment transaction.
3. Eligibility
You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you meet this requirement and that you are not prohibited from accessing the Platform under applicable law. The Platform is intended for professional and sophisticated users including investors, analysts, and financial professionals. Consumer protection provisions that apply to retail investors may not apply to all Platform features.
4. Account Registration
To access certain features, you may need to register an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify VirtualSilvr immediately of any unauthorised use of your account. VirtualSilvr reserves the right to suspend or terminate accounts that violate these Terms.
5. Intellectual Property
All Content, trademarks, logos, and software on the Platform are owned by or licensed to VirtualSilvr. You may not reproduce, distribute, modify, or create derivative works from Platform Content without our express written consent. Limited, non-commercial use for personal research is permitted provided that you attribute VirtualSilvr as the source.
6. Prohibited Use
You may not: (a) use the Platform to scrape, crawl, or extract data in bulk without authorisation; (b) attempt to reverse-engineer, decompile, or access any non-public portion of the Platform; (c) use automated means to access or use the Platform in a manner that exceeds normal usage; (d) resell, sublicense, or redistribute Platform data or Content; (e) use the Platform for any unlawful purpose or to violate applicable securities laws or regulations.
7. Disclaimer of Financial Advice
VIRTUALSILVR DOES NOT PROVIDE INVESTMENT ADVICE. ALL CONTENT, DATA, ANALYSIS, AND REPORTS ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND DO NOT CONSTITUTE FINANCIAL, INVESTMENT, LEGAL, OR TAX ADVICE. PAST MARKET DATA AND HISTORICAL FUNDING TRENDS ARE NOT INDICATIVE OF FUTURE PERFORMANCE. YOU SHOULD CONSULT A QUALIFIED FINANCIAL ADVISOR BEFORE MAKING ANY INVESTMENT DECISIONS.
8. Data Accuracy
VirtualSilvr sources data from multiple third-party providers, public filings, and proprietary research. While we endeavour to maintain accuracy, we make no representations or warranties regarding the completeness, accuracy, or timeliness of any data on the Platform. Data relating to private companies is inherently subject to information asymmetry and may be estimated or unverified.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIRTUALSILVR AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR RELIANCE ON ANY CONTENT. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNTS PAID BY YOU TO VIRTUALSILVR IN THE TWELVE MONTHS PRECEDING THE CLAIM.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with applicable law. We are currently establishing our legal jurisdiction in consultation with regulatory advisors across EMEA. This section will be updated once our corporate and regulatory structure is finalised. Users in the European Union retain all rights afforded to them under EU consumer and data protection law regardless of governing law provisions.
11. Changes to the Platform
VirtualSilvr reserves the right to modify, suspend, or discontinue any part of the Platform at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Platform.
